Trump Administration Granted Stay In Tariff Case
A day after importers won a big victory when the United States Court of International Trade struck down much of the Trump administration’s tariff program, a federal appeals court granted a stay which will allow the tariffs to remain in effect for the time being. The Trump administration had planned to petition the Supreme Court for emergency relief in the case if the stay was not granted by the appeals court.
Separately, a second federal court ruled against the administration’s authority to impose broad tariffs yesterday. Similar to the ruling from Wednesday, the U.S. District Court for the District of Columbia found that the administration overstepped when it imposed its sweeping tariffs under the International Emergency Economic Powers Act (IEEPA). That ruling is subject to a stay of two weeks, which could be extended further. As of now it appears likely the tariffs will remain in effect as the cases make their way through the courts.
