Over here in Cannaland, the lawsuits fly weekly. It is hard to keep up. They eventually make their way through the system, and then, of course, there is another lawsuit based on the ruling.
The most aggravating lawsuit is a judge ruling that shutting down 1000 businesses accused of illegally selling cannabis without a license is unconstitutional because it denies shop owners their right to due process. Is that how they did it in the days of illegal bars and hooch-making during Prohibition?
This mess continues to show how the OCM was set up. They decided to control everything. Only the OCM can rule over closing illegal shops. The laws must change for the police to do their job. It goes back to Cuomo, who wanted nothing to do with so he let some state senators create the legal structure. Everything always goes back to the legal structure
It’s just another cog in the wheel. Dispensaries have to put up with illegal dispensaries for the time being that are starting to crop up again, and the DEA has some crazy shenanigans going on, too, and is postponing the hearings to change the status of cannabis.
A daily uphill climb. I wonder how long it will take to fix this mess, and will it ever get easier?
